Terms and Conditions of Use

These Terms and Conditions govern purchases made through the Ruptture online store and the use of the digital service “Memory Vault” provided by Ruptture Studios S.L.

2. Products

2.1. We sell high-quality clothing.

2.2. Products include access to the Memory Vault, provided through a QR code that directs you to the web application, and a physical card inside the package containing a multi-use access code.

3. Countries we sell to

We sell and ship to: Spain, Portugal, France, Italy, and the Netherlands. Shipping costs and delivery estimates are shown at checkout.

4. Prices and payment

4.1. Prices are shown in EUR and include applicable taxes unless stated otherwise.

4.2. Payments are processed via the methods offered at checkout. Currently: Redsys.

4.3. We may cancel orders where we detect fraud, abuse, or obvious pricing errors.

5. Cancellations

Cancellations are only accepted before the order is shipped. Once shipped, you must use the returns process.

6. Returns and withdrawal (physical products)

6.1. You may return/withdraw from your purchase within 15 calendar days from the day you receive the Product, provided the conditions below are met.

6.2. Returns are accepted only if the Product is unused in perfect condition with tags and original packaging where applicable.
We do not accept returns of worn/used items.

6.3. Return shipping cost: the customer pays return shipping in all cases, except where the Product is defective or we shipped the wrong item.

6.4. How to return: email info@ruptture.com with:

  • order number
  • buyer email
  • items to return

6.5. Refund timing: if everything is compliant after inspection, we issue the refund within 3 days after receiving and checking the returned Product. Refunds are made to the original payment method.

7. Legal warranty

Products are covered by the mandatory legal warranty applicable in the country of the consumer. If the consumer is in Spain, the legal warranty for new goods is 3 years from delivery (subject to the applicable rules and exceptions).

8. Memory Vault (digital service)

8.1 What it is

The Memory Vault is a private digital space associated with a specific Product, where you can:

  • upload images into a carousel/album, and
  • unlock rewards (e.g., discounts and/or physical gifts) when you complete in-app requirements.

8.2 Access (no account / multi-use code)

  • No account creation is required.
  • Access is provided by entering the multi-use code in the web application.
  • Anyone who has the code can access that Memory Vault. You are responsible for keeping it private if you do not want others to access it.

8.3 Resale / transfer

Because the Memory Vault is accessed via the code tied to the Product, if you resell the Product and provide the code, the buyer may access the Memory Vault. Ruptture does not mediate private resales.

8.4 Lost code / replacement

If you lose your code, we may issue a replacement only if you provide proof of purchase (e.g., order number + purchase email + verification details). We may deny replacement where we cannot verify ownership or where there are signs of abuse.

8.5 Included duration and optional renewal

  • Memory Vault access is included for 1 year from purchase (or from activation if the app states otherwise).
  • After the included year, access may be renewed by paying an annual renewal fee shown in the app before you pay.
  • The renewal fee may change for future renewals, but never retroactively for renewals already paid.

8.6 Downloads / export

You can download/export your uploaded images from the Memory Vault via the features provided in the app.

8.7 Service availability

The Memory Vault may be temporarily unavailable due to maintenance, upgrades, or issues outside our reasonable control. We do not guarantee uninterrupted availability.

9. Rewards: discounts and physical gifts

9.1 General rules

  • Rewards may include discount coupons for future purchases and physical gifts.
  • Reward availability may depend on completing specific actions inside the Memory Vault and may be subject to stock, campaign limits, and anti-fraud checks.
  • Limit: 1 reward per Product / code and/or per anti-fraud rules (e.g., per user environment).

9.2 Discount coupons (expiry)

  • Discounts are provided as coupon codes.
  • Coupon codes expire 3 months from the purchase date, unless the coupon states a different expiry date.

9.3 Returns when a discount was used

If you used a discount coupon on an order and then return that order:

  • you will be refunded only the amount actually paid, and
  • the used discount is considered spent.
10. Effect of returns on the Memory Vault

If you return the Product associated with a Memory Vault:

  • we may disable or suspend access to that Memory Vault, and
  • we may cancel eligibility for rewards linked to that Product/code.
11. User content (images)

11.1 Your responsibility

You confirm you have all rights needed to upload the images and that your uploads do not violate third-party rights (privacy, image rights, IP, etc.).

11.2 Prohibited content

You must not upload content that is illegal, hateful, threatening, defamatory, discriminatory, infringes rights, contains malware, or otherwise violates applicable law.

11.3 Ownership and limited license

You keep ownership of your content. By uploading it, you grant us a limited, non-exclusive license strictly necessary to host, process, and display your content within the Memory Vault for the service to function.

11.4 Reports and enforcement

We do not pre-moderate content, but we respond to valid reports. We may remove content or restrict access where necessary for legal, safety, or rights-protection reasons.

12. Marketing use of images (only with explicit consent)

We will only use user images for marketing (website/social/ads) if we obtain explicit, verifiable consent from the user.

13. Intellectual property

All site/app elements (brand, designs, logos, content) belong to Ruptture or licensors. Purchasing a Product does not grant any IP rights.

14. Changes to these Terms

We may update these Terms for legal, technical, or business reasons. Updated versions will be posted with a new “Last updated” date.

15. Governing law and disputes

These Terms are governed by Spanish law. If you are a consumer, this does not affect any mandatory consumer rights under your local law, and disputes will be handled by the courts that are competent under applicable consumer rules.
